Car accident and the person won't pay??


I was in a car accident and it was their fault. We didn't call the police or anything but we did get all the information about the person that hit us. And the insurance company had been calling them to tell them how much they gotta pay but they won't answer the phone at all. They won't answer it on purpose. We even tried calling them and they won't answer or anything. So should I call our lawyer? or what should I do? The damage costs about $4,000.

I'm not sure where you are, but in a number of places these days police do NOT need to attend motor crashes unless a patient is hospitalised, a person is trapped, a driver fails to stop and provide their details or a vehicle needs to be towed off the road. Even in these cases, insurance companies determine "fault" and police have very little to do with the process - you can even report a minor accident to police now over the phone!

A growing number of Police Forces are chosing not to attend minor motor vehicle crashes... because they don't need to.

Your insurance company will have their own legal team to chase up this other person, but your insurance should pay for your repairs in the meantime. You don't need your own lawyer.

If you have uninsured motorist coverage, you can file with your insurance company. Then the insurance company lawyers will get involved trying to get the other person to pay--it's called "subrogation" of a claim.

Worst case scenario, they don't collect but your insurance will still pay the claim. Your rates might go up in the future depending on what else you have filed, but you wouldn't be out the attorney fees yourself.

If you don't have uninsured motorist coverage, then you have to weigh whether or not it is worth it to hire an attorney. Chances are you might not collect enough to offset the attorney fees and make it worth your while.

Without a police report you can not back up the story, and legally they will not be held liable. If you are lucky you may be able to get 1/2 the amount in damages if you take it to small claims court but even that is a long shot. It sounds like the accident happen awhile ago so you would not be able to file out a police report now. Without a police report no insurance company is going to pay.

Well like the guy said you should have gotten a police report to clearly show liability.

If they have insurance...why doesn't your insurance company deal with their insurance company instead? So that company pays your damages and his/her rates go up....you get your money back.

IF the insurance companes agree they need to pay and they won't I'm sure there are ways to pressure them to pay...most likely the insurance company will pay you..and send a collection notice to them.........I think you need to speak to your insurance representive again and if they can't give you a clear answer speak to a lawyer friend to figure out whats going on.

If the companies agree he is liable you should get your money back no problem

You didn't call the police. Mistake #1. Assuming that telling these people that they owe you $4,000. Mistake #2. Thinking you will collect anything at all from these people whether you go to court or not. Mistake #3.

SUE HIM! youll get millions!
