B/F's driver's license suspsended - how can he get it back? |
A few years ago & before we met, my B/F got into an auto accident - he rear ended the car in front of him. He wasnt aware that his insurance had just expired, so he was not insured and had to pay for the other cars damage, which it was basically totalled because it was a peice of crap Kia. This happened in the state of Indiana, and by what he tells me, the judge told him he cannot have his license back until he pays the $8k-9k back to the insurance company for the car that was totaled. To me this is absurd - how do they expect him to DRIVE to work and make money if he doesnt have a driver's license? This is currently causing HUGE issues because he is looking for a new job and cant apply to most because they require a drivers license. Anyone know what we can do? He had been making payments to the insurance company, but hasnt in a few years due to financial hardship. What can he do? We have a daughter and he needs to find a good job to help me support her. How wasn't he aware his insurance expired? It expires on the same day every year and you get a notice to renew in advance. I live in Indiana. The courts simply don't care. They expect your family to take care of it or a friend drive him back and forth. Sometimes and I say sometimes you can go through the court and get a temp. for driving back and forth to work. He is probably on probation so I would ask his officer. If not go to the BMV and ask them how you can do it. You stated "he hasn't made payments in a few years". I doubt a judge would even grant a hardship license in this case. He has been irresponsible and is paying for his actions. Not buying the part about him not knowing his insurance was cancelled. he can go back in front of that judge and file a motion for a work license which allows him to only drive to and from work. He might be able to have his license to go to and from work. They expect him to pay what he owes I live in Indiana as well. Check with an attorney in the county you guys live. Here in Tx, even if your license is suspended, one can get an occupational license, which permits driving to and from work, school and for essential household duties. You will have to pay court costs, of course, as the attorney will have to file a lawsuit to get the court ordered license. He will probably also have to obtain a special type of auto insurance. In TX it's called an "SR-22." I did it for a client in the exact same situation here in TX |
