B/F's driver's license suspsended - how can he get it back?


A few years ago & before we met, my B/F got into an auto accident - he rear ended the car in front of him. He wasnt aware that his insurance had just expired, so he was not insured and had to pay for the other cars damage, which it was basically totalled because it was a peice of crap Kia. This happened in the state of Indiana, and by what he tells me, the judge told him he cannot have his license back until he pays the $8k-9k back to the insurance company for the car that was totaled. To me this is absurd - how do they expect him to DRIVE to work and make money if he doesnt have a driver's license? This is currently causing HUGE issues because he is looking for a new job and cant apply to most because they require a drivers license. Anyone know what we can do? He had been making payments to the insurance company, but hasnt in a few years due to financial hardship. What can he do? We have a daughter and he needs to find a good job to help me support her.

How wasn't he aware his insurance expired? It expires on the same day every year and you get a notice to renew in advance.

The judge was pretty clear on how to get the license back: pay for the damage he did to the other car. If he gets a job he can walk, bike, or commute to, then to simplify things he certainly should.

This will all be behind you in a couple of years if he gets his act together.

I live in Indiana. The courts simply don't care. They expect your family to take care of it or a friend drive him back and forth. Sometimes and I say sometimes you can go through the court and get a temp. for driving back and forth to work. He is probably on probation so I would ask his officer. If not go to the BMV and ask them how you can do it.

You stated "he hasn't made payments in a few years". I doubt a judge would even grant a hardship license in this case. He has been irresponsible and is paying for his actions. Not buying the part about him not knowing his insurance was cancelled.

he can go back in front of that judge and file a motion for a work license which allows him to only drive to and from work.
he can explain the same situation that you have explained and the judge more than likely will grant that motion

He might be able to have his license to go to and from work.
I know of people who have gotten theirs suspended but they can use it to go to and from school and to and from work.

They expect him to pay what he owes
APply for a hardship license; will let him get to work and back; probably just has to be making regular payments on the DMV award.

I live in Indiana as well.

You can ask the judge for a grant to drive to work,
which will allow him to only be driving between certain
hours. Downside, he will have to carry his schedule with him at all times in-case he gets pulled over. I'm pretty sure
his manger will have to sign the copy he carries.
The judge usually will approve of this.

If you want to take a different path, my boyfriend
got pulled over for not having proof of insurance
and we went to court, got proof and they reinstated
his license.

Check with an attorney in the county you guys live. Here in Tx, even if your license is suspended, one can get an occupational license, which permits driving to and from work, school and for essential household duties. You will have to pay court costs, of course, as the attorney will have to file a lawsuit to get the court ordered license. He will probably also have to obtain a special type of auto insurance. In TX it's called an "SR-22." I did it for a client in the exact same situation here in TX
