Can somebody help?????


i was in an accident in February, i found out that my insurance had expired 2 weeks before that and yes its my fault i didn't know it was expired but it was only gonna cost me $2.38 to continue it for another month, anyways i got 2 tickets failure to yield and no insurance i paid my tickets and i tried working out a deal with the lady on getting her vehicle fixed by her going to the person I'm buying my car from and he was going to fix it and add so much a month to my payments . she told him she didn't want it fixed that she wanted a new car! she sold her car for $1500 and my license is now suspended. the letter said until i have an agree b/t the parties or pay $6121. what i want to know is since she sold her vehicle for 1500, shouldn't i just have to reimburse her that amount? if she refuses for me to get it fixed then sells it how am i suppose to pay for the vehicle? what if she refuses any type of agreement i offer her? i have two kids a 5 yr old and a 4 month old and I'm a full time college student and i have a very limited income. what can i do to get my license back?

She has a duty to mitigate or lessen her damages, if possible. I suspect if she is aware of your financial status, she may be more willing to compromise so that she gets at least some of her damages. Otherwise, the case will go to small claims b/c the monetary amount is so low.

As for your DL, you must contact the DMV in OK, pay a renewal fee, show proof of insurance (or "financial responsibility") and take care of any other outstanding issues DMV may have.

Obviously, Oklahoma has a very strict financial responsibilty vehicle owner law. In many other states this lady would have had to sue to collect. But, if she had a correctly adjusted loss, or correct book value you may just be stuck. Consult a local attorney if you haven't yet. Guarantee you it won't cost you $6000.00 and so far you haven't paid her anything, right?

I think its weird that she sold the car, but I can see why she wants you to pay the VALUE of the car... She took a loss by selling a wrecked car. I'm not sure she handled the situation ethically, but I can see where she's coming from slightly... Good luck. I'm sorry that happened. Sucky lesson to have to learn... those always seem to happen, huh?

the issue is your license back, we don't need 2 know bout kids or college. simple contact your dmv and let them tell what u need to do.

a couple of things.

first of all, your insurance company has to send you a cancellation notice, informing you that your insurance will be canceled if you do not pay the 2.38. if they did not send you a notice, you still were insured. i work at a law firm in michigan, and this happens all the time. if you feel you were insured, see if you can get an attorney to help you with this issue.

in the meantime, get a copy of the police report and see what the year and make of her vehicle is. go on line and get the blue book value. i would also get a few estimates from local dealerships in the area. get three bids if you can.

contact the place that sent you the letter and see where they came up with the 6121 and present them with your estimates you got.
