I won a lawsuit about a year ago. I haven't seen a dime. Where do I start? |
Two kids smashed up an antique car I own that is parked in a garage. I didn't have insurance on it because I just inherited it and hadn't saved up enough money yet to put insurance on it. The car was worth $244,000 and can't be fixed or replaced. The kids smashed up everyone's car and other property on the entire block including 4 ambulances and a fire truck. The police caught them and they pleaded guilty in court. The judge ordered them to pay us and or they will take what their parents own and auction it off. I've not heard anything other than a letter saying that one of the kids was in some kind of jail and moved to the lower part of our state. I'd like to get this auction rolling because I know they don't have the money to pay. Who do I call first to get to the bottom of this? Also if I have to take time off from work, how do I go about seeking money to cover the wages I've lost? Were these "kids" minors at the time? Unless they were their parents are not liable, no matter what the criminal court judge said. If they were, then you still have to go to court to obtain a judgment against them. The chances of theses "kids" & their parents having a quarter million dollars left AFTER they've paid for 4 ambulances & a fire truck are not great. The city's gonna get their money first because THEY HAVE ATTORNEYS -- or their insurance company does. And that's what you need. You have learned a very expensive lesson. According to your question, there is no indication of a lawsuit. You may have to file a civil action against the boys' parents to get anything actually rolling. You may eventually recover some of your loss, depending on the offenders' and their parents' financial status. You will be unlikely to get compensation for missed work From what you said, there was no lawsuit. There was a criminal case where they were ordered to pay. Since they didn't pay, you should get a lawyer and sue the parents of the kids. You may be able to seize the parents assets for failure to pay, or you may just garnish their wages. Contact a Lawyer Spankey and stop it with the how can I get them for their last dime by over inflating my hardships. You can get more done by being a square shooter. The bad news is you were foolish not to insure such an expensive item and are likely never to see an dime. |
