My neighbor hit my unattended parked car. Can I get money out of this? Should the appraiser come to my house?


Two weeks ago, my neighbor backed into my unattended parked car (near a fire hydrant).
Her insurance offered to pay only 90% because it was parked illegally... even though severa; lawyers told me it is 100% her fault. Parking by a fire hydrant only gets me a fine. It was her negligence.
Anyway, I got several estimates and they are roughly about $3,000.
Is there anyway I can make money off of this? How?
Should I have her insurance's appraiser come to my house and look at the car... have him write me a check, then use the money to get it fixed somewhere cheap?
or have the appraiser look at the car in a mechanic's shop?and have the mechanic 'hustle' the appraiser and get more money out of him and as a result I do not have to pay the 10% out of pocket. The mechanic would 'ask' for more (internal damage) in order to pay for my 10% of the cost.
I also need a rental car since this job will take about a week. How can I get her insurance to pay it?
What should I do? Tips? Advice?

You should take the 90% they are offering and if you can find a shop that will fix it for that amount. You could either ask the adjuster meet you at your home or at a shop.

Some insurance companies will only make out a check to a licenced body shop/mechanic for the actual amount they agree to pay, which is legal and is to avoid scams like to you propose to try to make a profit off out of an accident.

Her insurance company should cover the cost of a rental car while the car is in the shop, but they will only pay for basic rental, not any additional insurance per day - that will be out of your pocket if you chose to purchase it. If the insurance company does not have a pre-existing contract with the rental company (most large insurance companies do with many national rental chains), but if they do not, most rental agencies will give you a price break, like $20-25 a day (rental fee only) and you would submit the invoice to the insurance company for reimbursement (be sure to check with the adjuster before hand as to their exact policies and procedures).

You cannot have a mechanic "hustle" and get more money out of the deal that what it actually would cost, otherwise you are commiting a criminal act of fraud against the insurance company.

Most mechanic's office's will report your request inflate the costs to make a profit to the insurance adjuster just to cover themselves and remain in the good graces of insurance companies, which could be used against you in Court should it end up going to Court.

As you were illegally parked, if it goes to Court, there is the strong probability that you will not get anymore than the 90% the insurance company has proposed, and then will be out the filing fee.

Even best case scenario, if you would win in Court, the Judge may order the insurance company to pay the 90% that they have already agreed to pay and the titled owner/driver have to pay the 10% and then it would be up to you to go about trying to collect that amount.

Another thing to keep in mind that if your neighbor finds out your user id on YA and finds this post, they can use it against you in Court.

Well I'd say that if u have your car adjusted and you have there insurance adjuster take a look at it, most of the time when you take a car to the mechanic shop they will say they won't give you a free appraisal, they will only do that if you have it worked on there.. SO I'd say good luck..
Why sue? I mean possibly you will have to have away back and forth to your job?

You're trying to MAKE money off of this? What have you done to actually think you have the right to PROFIT from this?

If you weren't parked illegally, your car wouldn't have been hit. Be glad the neighbors insurance company is willing to pay anything, much less 90%. Take it and run. Pursuing it will not pay out in your favor.

HAVE THE CLAIMS ADJUSTER MEET YOU AT THE BODY SHOP WHERE ITS GONNA BE FIXEDAND HAVE THE MECHANIC GIVE THEM THE ESTIMATE TO COVER 100 PERCENT. IF THE NEIGHBOR HAS RENTAL CAR INSURANCE ON HER POLICY THEN HER INSURANCE WOULD HAVE TO PAY IT. GOOD LUCK.

Do you have insurance? Maybe you can get your insurance company to help with these jokers. Been through that kind of problem before. Not that my car was parked illegally but they said since we did not have full coverage on it, they would only pay what its wholesale value was and it was an old car. It was also a collector but not with the whole side caved in. More recently a woman ran a stop sign and hit the rear fender when my daughter was driving. Turns out we both had the same insurance agent. They not only paid to get my car fixed but they paid for a rental while it was being fixed.
They short changed me on the size of the rental but I did not get the paper work saying that they were suppose to give me one that had the same seating capacity of mine until the day I was picking up my car.Our Toyota Sienna seats 7 and we got a car that seats 5 if one is a small kid. You can hold out and tell them that you want 100% but they are counting on you not wanting to take the time to go to court. That was why I let the first insurance company get away with ripping me off. I had moved to another town and did not want to fight them over money I would use up fighting them.
You might be able to find a place that will give you a higher appraisal that he will actually charge you so that what the insurance company pays will cover his cost.
