Signed over my car, they wont put it in their name?


My brother friend gave us $700 for our car We signed the title over, canceled the insurance & turned in our tags Few weeks later MVA sends a letter my husbands license will be suspended since the car does not have insurance on it. I emailed the guy several xs w/ no reply. I threaten to take the car, & he says it will be taken care of that week. Next week I email him again, he says it was taken care of. I seen him with my brother & asked him again if it was put in his name. He tells me yes, I ask to see the title & he claimed it is in the mail. Over 4 months have passed & we called the MVA & they say the last person the car was registered to is still my husband We are legally responsible 4 what happens with the car & my hubby is being fined lapse of insurance, we have given him enough time to put it in his name. Can we legally take it back? We can go to the MVA & get a new title since it is still in my husbands name. What can he do about it if we do?

We did not get a bill of sale, in any form.

No, you can't take it back. However, most MVD will let you file a sold notice.

when you got it from the user you have to include the name essential? It should be entered on your name?

You should have taken him to DMV and signed the title over to him in front of the clerk. That way, you know the title was signed over and everything is complete and taken care of. You could always seek the advice of a lawyer. Has this guy given you a reason why he hasn't put the vehicle in his name yet?

Also, you should've written up a notice that stated you were selling him the car for 'X' amount, and both of you should've signed it, with each having copies for your records. Since you didn't do this, and he's taking his sweet time doing the proper paperwork for the car, you probably could legally take the car back from him. Again though, I would discuss any actions like this with a lawyer. Either way though, I hope it all works out well for you. I think after all this, I would probably make him pay the fines that are being issued to you for not having an insured vehicle.
