Can an insurance company state a person gave them a verbal OK to a settlement with out any proof of it?


An insurance agent told my brotherer's attorney that he made a verbal agreement on a settlement. But yet he has no telephone recording of it. My brother only requested the document with the amount of it to give to an attorney to review before he would agree to anything. He was skeptical of amount of the settlement quote. Can an insurance company claim a verbal agreement without any proof other than their word against the person's?

If he didn't sign a release yet then there's no deal anyway.

There is an old saying, "If it ain't on paper, it didn't happen!" That should about cover the whole incident. The insurance company, may think or claim that as your brother asked for the written papers, that he agreed. This isn't so.
