Do children of the deceased have rights to their parents life insurance? |
I just turned 20, and my father died when I was 19. My mom got $54,000 and is waiting on another $50,000. She said that Florida law says me and my sister are entitled to $10,000 each, but has yet to give it to us. You are a primary heir of your father just like your mother and so you are entitled to a share of the inheritance left behind by your father including his money and other assets. However, usually when it comes to insurance, it drprnds on who was designated by him as the beneficiary. If you and your sister were included as beneficiaries by your father then you are netitled to a share of the proceeds. You are over the age of 18, which means if your father had named you as one of his beneficiaries, the insurance company would have to give the money directly to you. The owner of the Life Insurance policy can pick more then one beneficiary with a certain percentage to each. I would suggest getting a copy of his policy and read it through. If you are entitled to a certain amount of money, the check wouldn't go to your mom (unless you are still a minor in which it would be payable to you but care of your mother), it would be sent to you for deposit. If he named you as a beneficiary you are entitled to money. She may have decided to give you and your sister $10,000 each based on the money that she is receiving from the insurance.
