Is it legal to record phone conversations that the other party is recording? |
Lately, I have a lot of dealings with insurance companies. At the beginning of every phone call, they notify me that this call may be monitored or recorded. This question has been settled in court, and you may be surprised by the result. Depends on the state. In some states single party notification is all that is required. As such, as long as you are a party to the call you can record. However, other states have two party notification requirements. if you do not KNOW for sure where the other person is located then you should assume two party notification is required. As such, the person making the recording (you) must make the notification. The notice provided by them does not notify them that you may be recording the call. Under the law, it is known as "one party consent", everyone takes the risk that the other party they are talking to is recording the conversation.
