Is it legal to record phone conversations that the other party is recording?


Lately, I have a lot of dealings with insurance companies. At the beginning of every phone call, they notify me that this call may be monitored or recorded.

Since I received that message, do I have to notify the other party if I am also recording the call?

This question has been settled in court, and you may be surprised by the result.

First off, if you live in a "one party" State and it's an in-state call you can tape away all you want.

But.... if you live in an 'all party' State, or the call is interstate, you have to tell them you're recording the call, even if they tell you that they are.

Depends on the state. In some states single party notification is all that is required. As such, as long as you are a party to the call you can record. However, other states have two party notification requirements. if you do not KNOW for sure where the other person is located then you should assume two party notification is required. As such, the person making the recording (you) must make the notification. The notice provided by them does not notify them that you may be recording the call.

Simply state at the beginning of the conversation:
"Since you may be recording this call, I am also recording this call"

Under the law, it is known as "one party consent", everyone takes the risk that the other party they are talking to is recording the conversation. So, yes, feel free to record whatever conversations you wish.
