I was in a wreck, that was not my fault but the insurance was in my husbands name, am I to blame?


the wreck was on a private lot, no police report ,no witnesses she highfived me called it a day and then i get a certified letter 1 mon. later saying that I had no coverage so I owe her insurance company 900.00. It wasn't my fault, but am I considered to be completly at fault because I was not on my husbands insurance? I live in California if that helps any. Thankyou

The amount you would owe her has NOTHING to do with whether or not you were insured. Also, car insurance does not depend upon the named insured, it depends for the most part upon the VEHICLE insured. If the vehicle is insured everybody driving the vehicle is insured, unless you are specifically EXCLUDED from coverage (or were not authorized to drive the vehicle). You (or your husband) should contact your insurance company to verify whether you were insured, and you should file an SR-1 report with the DMV (it is late, but better late than never).

If you were driving your husband's car (HE had insurance I hope!) but YOU weren't on his policy! That was stupid if he knows you DO drive! As the owner of the car, which I am assuming it's him, HE is responsible for the accident, even if he wasn't in the car!! HE should have called his insurance company immediately! NOW, a month later, you get this certified letter about the other driver's damages! Seems like she did her homework! and you didn't! She got you good girl! Now you have to face the music with your husbamd!

If you live with your husband, you have a problem.

it's a civil suit cos it was on a private lot but you still have to pay the same cost.
