Insurance adjuster has told us CA law says we split cost of fence replacement with our neighbor, is that right


Our fence was taken down in the winds and the adjustor only paid us for half of the value of the fence becasue he says CA law states that the fence on the property line is legally owned half and half by us and our neighbor even though we put the fence up. That doesn't make sense to me.

If it is directly on the property line, then yes. That's why you should always allow a setback to make sure it is only on your property.

However, most insurance companies will reimburse you 100% for the fence if you put it up. Call the adjusters boss or read your policy

I would produce receipts and expenses to your insurer and explain you built the fence. If they refuse to pay your expenses in putitng it up, then I would contact your state's Insurance Commissioner.
