He didn't want my insurance or to call the cops at the accident scene, now he want me to pay! What can I do? |
I was involved in a minor "MINOR" car accident. Minor meaning barely scratching the paint off the bumper of the car, NO DENTS at all. It was mainly my fault and I offered to give my insurance info, but the driver said to forget about it and it wasn't even worth it. This was after he took my number down. We did not call the cops because like I said it wasn't a big deal. Now 2 weeks later he calls me talking about he got a quote and it's $800+ to fix his car. Is there anything I can do or do I have any rights? He refused to take my insurance info and agreed the day of the accident that it settled there. And now he want me to come out the pocket over $800 for a few scratches. Any advice on what I should do? Thank you all in advance for any advice and all suggestions. Very much appreciated!!! Ask for the quote from the body shop that his Insurance Company sent him to so you can turn it into your Insurance Company. Let me know if he stutters. At this point, its up to him to prove his case in court if he wants money from you. If he was dumb enough not to want to get insurance involved, it's his problem. You could offer to pay a portion of the repair if you believe it's truthful, but honestly, at this point, i would just tell him to live with his decision, and if he wants money, let him prove his case in court. Tell him to go piss up a rope. He doesn't have a legal leg to stand on. Report it to your insurance agent and have them take care of it. I have a feeling that the other person doesn't have insurance, and, maybe other issues with the police, so don't let them bully you. They're lying because, worse case, (notice I said worse case) its a $400 job. Stop dealing with him and immediately contact your agent! He either doesn't have insurance or is planning to pocket the money, you have 30days to report it so call your insurance agent and tell them what happen and they'll fix him. obviously there should have been pictures taken , a scratch is not worth $800. . A little sandpaper and paint is all it needs, not a new bumper..Someone is lying. Call your insurance company and give them the info on the collision and on the other guy. They will take it from there. Contact your insurance company. This is a common scam. Well you have two options 1) The high road. Call your insurane company and tell them what happened. They'll take it from there. 2) The not so high road. Don't call the guy back. If he calls back tell him you remeber him saying 'don't worry about it'. If he wants money from you his only option is to take you to court. If he does take you to court, then inform your insurance company as soon as you get the court papers. Your insurance company will then settle it before court. Always get a police report. He probably has no insurance or even a license. I have been threw this and so has my daughter, in my case the guy backed into me and when i asked for his information he shook his head no, he didnt speak english. I had my daughter call the police. It was in a parking lot i didn't move my car so he couldn't get away, when the cops got there they ended up impounding his car because he had no license or insurance. In my daughters case she was rear ended luckily it was close to home and she called me, the lady was begging us not to call the police shes a christian women (so she kept saying) and wanted my daughter to follow her to her house so she could give her money.(never do anything like that) I told her No we need a police report. I've been through this before. When the cops came, I told them she smelt like alcohol, the cop didn't smell it on her, probably because she chewed a pack of gum before they got there, but it ended up this christian woman(lol) had 3 warrants for her arrest, and went to jail were then they found she also had been drinking. So always call the police and get a report Terri M is right. The reason you have insurance is to protect you from just such scumbags. He cannot demand that you pay it out of your own pocket instead of insurance. If he is adamant about not using insurance, he probably has something to hide. Report the accident to the police as well as your insurance company and tell them he is trying to extort money from you. yu need to call your insurance and tell them next time you need to tell your insurance right away but u might still beable 2 even if he refuses your information take as much as his as you can even if you dont call the cops most state the only time u need to call the cops is if theres more then $500 visable damages or some ones hurt |
