What can I do to take possession of a car that I co-signed for my child who's a co-buyer who's deliquent?


She has missed a payment and can't make her insurance payment. She took the car and told me that I had no right to keep the car from her. I really want her name off so I can sell it and not ruin my credit.

Who is on the vehicle title?

If you are there, take a key and get the car, It's yours as much as hers; especially without a valid insurance statement.

If not, you will end up in court unless she agrees to give it back.

There are two issues here. Who has title to the car and who signed the loan agreement. If she is the only one on the title of the car, there is nothing that you can do to get hold of the car. There is probably nothing that you can do if you are both on the title. If she is not on the title, then you might have to involve the police/courts to get the car back.

If your the sole name on the loan or if you are both on the loan, then the bank will come after you to pay as you have money. You do run the risk of having your credit ruined.

Looks like you might have to talk to a lawyer either way.

Get all your proof together and file in small claims court. I see it on Judge Judy all the time.
