My neighbor's tree fell on my property?


His tree was rotting and fell on my fence and has destroyed my fence and dog house. He says it was an act of God. We live in Alabama. Does anyone know the law about this one? He hasn't been forthcoming with his insurance information.

The Act Of God clause is totally outdated. He needs to give you his insurance information. You can either file a small claims case or get the insurance information yourself. If you go to the county courthouse land records office, you can look up the information on the purchase of his house and that should include the home owners insurance information.

Happened to me, too. They were out of town when it happened and as it fell on my front porch. We took pictures and chopped it up. We also took pictures of other trees that were on the way and sent it with a letter from our lawyer.

I think you could do it a lot cheaper by filing a civil suit. If you do not have a lot of very good pictures it would be hard to do.

It is his responsibility though to pay to fix it. "Act of God" is baloney. His insurance company may not pay him but that doesn't have anything to do with what he owes you!

Take pictures of the rotted tree. If the tree fell in results to it being rotten it is his responsibility to repair the damages. This has happen to my family in MD.

Your own insurers should guide you on this one
