Guy owes me money - accept payments?


A drunk driver smashed into my car and he doesn't have insurance and I don't have unins. motorist on my policy. I'm going to file for small claims court, but he offered to pay a 'little money' upfront and possible payments later. Should I 'take what I can get' and risk not getting anything more or wait and try to get the whole amount in one shot and risk not getting anything at all?

If you accept his offer then by all means get it in writing. Write up a contract specifying the amount owed, cause, payments & date due, and a statement something to the effect that "all payments must be made on time or a demand for the full balance will me made after 10 days after missed payment". Have it signed and witnessed or notarized, that way you have something to fall back on if and when you take it to court.
