Legal advise?


I was in a car wreck and the officer found no one at fault months later i recieved a legal notice stating that i was sued for x amunt of dollors for thhe wreck. when i called the lawer's office they told me because i did not have insurance in tennessee no matter what the officer's decision i was at fault any advise?

Get a lawyer. Countersue.

I seriously doubt that any state law would make a party automatically at fault for an accident simply by having no insurance. Not having insurance IS a crime, but it is totally unrelated to issues of Causation in an accident. It absolutely defies Logic.

Since the other party probably has insurance, you might find yourself getting a settlement, and that other attorney running like hell when your attorney asks for Court Sanctions.

If that really IS the law in Tennessee, you have a particularly idiotic legislature.

Get yourself a lawyer. The truth is.. no matter who the police report says is at fault, any party can sue the other. The question of fault lies in the Court's hands. My question is if you didn't have insurance in tennessee, did you have insurance else where? If yes, call your ins and see if they are willing to cover you. Different states have different laws on that. If they will, then they have their lawyer who fights for you. But if they don't ... or you didn't have insurance at all... you'll need to fight "why you were NOT at fault".. and counter-sue.

You may have been negligent per se by violating the state statute that requires having automobile insurance but that doesn't mean the accident is your fault (and therefore you are liable).
Get your own attorney.

MY advice would be to get your own lawyer don't listen to their lawyer.
