More questions about getting rear-ended....? |
If I was requested to go to court for what seems like the person who rear-ended me is fight the ticket. And the insurance is claimed and everything. How can they prover if i sudden braked or not? And if i did can they put the blame on me?And the road were wet what effect does that have? the person behind you is supposed to keep up to 1 cars length distance so that if u DO hit ur brakes suddenly they have enough time to avoid hitting ur car by stopping or swerving. If you suddenly brake, and the person ran into you, they were following too closely. Even if it's wet, the person should have increased their following distance. well even if you suden break they were to close to you then and they should have distenced them selve say that in court and if the roads were wet then once again they should have alowed for more reaction timw i hopw this hlep you out and as far as blaming you well just say those thing why were they so close they should have been about 3 car links behind you and if raining may even 5 so why were they so close did they feel that they could wreak say you made a sudden stop and get some part of there car fixed of your dime well i hope i helped good luck You would be getting away hands free. The car behind you should always ride one car length behind the other in case of incidents like this. If the roads are wet you have more of a chance because he should have rode two cars behind in wet weather where you should be more cautious. I would not stress about it. Regardless he hit you from behind the fault is none other then the faultee's hope this helps. He ran into you, therefore it is his fault. If he had a brain then he would have kept his distance on a wet road; four seconds at least in order to stop if the car in front brakes suddenly. It was his fault. End of. not all cases are the same, i rear-ended someone and i got no penalty what-so-ever. in fact, the girl i hit, got a ticket. and then tried suing me personally, not my insurance company for damages. it didnt work out too well for her.... It doesn't matter if you braked suddenly. That proves they were following too closely, which is illegal. It's called "assured clear distance." it does not matter is u suddenly braked or not. it is his foult as he should have kept a safe distance from u to begin with. if he rearended u no matter the circumstances u will win the case . 100% sure about it If someone hits your vehicle, from whatever direction, it is their fault. I am in the insurance business and if someone rearends you...it is ALWAYS their fault. |
