Should I get a lawyer...?


My 9 year old son had a accident the very first day of summer camp at the regular school.He was playing dutch ball and a kid throw the ball at him so hard that broke and dislocate his pinkie,in the hand that he writes with.He had a cast for a month.He could not go outside to play for a month.The very first day I had topay for a school insurance in case something like this happens.I did not feel out nay form the staff did,she explain to me the different prices,and is not from the school is call School Insurance of Florida. So she said to me there is one $12 or $18 0r $40 so I got the $40 Now I recieve a letter that I was suppose to send $12 and the rest is additional Now the insurance dont want to cover and the principal dont care. I told her I did not fill out the paper the hand write is not even mine Is $1,996.00 I have no insurance.You think is worthless to hire a lawyer for that accident and the negligence of them?This summer for him is been very sad.The boy is not in school anymore

Your question really is not that clear.

What kind of case do you think you have? Negligence against the other child (probably not a good case)?Negligence against the school for improperly assisting you with filling out an insurance form (probably not a good case)? Suit against the insurance company for non-coverage (maybe)?

I will tell you though that a lawyer is not likely to take a case like this on contingency, and you will need to be prepared to pay a consultation fee and retainer for any services in advance.

Why do you damn gringos always want to sue people for every little thing. It was an accident, what the hell does the school have to do with it....you wanted a child so you deal with it. Its your responsibility. hiring a lawyer is going to cost you more than the medical bill

Sure, I think a couple of letters from an attorney to the school/insurance company will be productive.

I cast on a broken hand is not going to keep anyone inside for a month. A couple of years ago I had a bike accident where the tip of my finger was sliced near off, and 3 fingers were broken.

I was back on the bike in a week.

when I was his age, a kid with a cast had a badge of honor and couldn't wait to show it off.

Because of that, honestly I feel there is something not quite right with your story.

But as for the insurance, do speak to an attorney. There are plenty listed in the yellow pages, many offer a free consultation. If one doesn't want to help, ask if they can refer you to someone that might want to.
