Can you file a civil suit against the people who hit you to recieve money for another car?


I was in an accident in May. The person who hit me ran a stop sign. However there were no injuries to myself or either of children but my van was a complete loss. I was given a rent-a-car but the insurance company didnt tell me when to turn it in. I recieved a paper in the mail on the 16th from the insurance company telling me that they were quit paying for the van on the 30th of the previous month. We havent even recieved a settlement or signed any papers. They just picked the car up. I also have two week vehicle storage bill and hospital / ambulance bills they wont touch because we werent hurt but we were examined. However my main question is do the people that hit me be responsible for me getting a down payment for another vehicle?

I didnt take an ambulance but the paramdic came over and looked at us and my son had a good size bruise on his collar bone from his seat belt so i drove him my self to the hospital to have him checked out.

they are responsible for repairing the car, or if totaled, the fair market value. If you were not hurt why would you take an ambulance,

Why would you think they would have to give you extra money for a down payment? Take the money the insurance gives you for you car and use that as a down payment.

Yes ,, U can ,, , But u would probably want to file a suit against your insurance company for not being clear with you about the rental agreement ,

the insurance is responsible for making you whole, and if it takes time to reach a settlement, then putting you in a rental car for as long as that takes is there responsibility too.

if it is the other driver's fault, then their insurance must negotiate with you, you are under no obligation to accept their offer, as long as you are negotiating in good faith.

I had a similar case once - my car was hit by another driver, her insurance wanted to total it, I wanted to repair it. Nonetheless, they put me in a rental, and a nice one at that, for about 9 weeks until we decided. In the end, it was only ~$2500, they probably spent more then that on the rental and could have settled with me the first day.

Since I had just mailed in the last payment on the care the day before the accident, I looked at it as if the other driver, or her insurance company, had walked up to me on the street and said "What will it take to get you to sell me that car?" Since the car was not for sale, I didn't feel the need to do what THEY said must be done - I didn't know them or the other driver. NO relationship business or otherwise existed before, so to me they were complete strangers offering to buy my car.

btw, by "make whole" I mean it is the role of any insurance company when paying such a claim to make a good faith effort to put you in the equivalent value car ASAP. Not the blue book value, but the actual replacement value, plus the cost of any incidentals resulting from the process, which is where the rental comes in.
