My dog was attacked by the neighbors dog through my fence. Is she liable for the vet bills? My missed wages?


My miniature dachsund was pulled through our picket fence by the german shepherd next door. A lot of vet bills have stacked up with surgery and boarding. Can the neighbor's homeowner's insurance take care of this or do I have to take her to small claims court. I was bit in the process and needed to go to the doc, get prescriptions. I missed 2 days of work, that had to use personal days for. Is this all I can sue for/claim for insurance to pay? The total should be under $5000 easy.

For the record, my dog was in our yard, and was pulled by the neighbor dog through the slats in the picket fence by her nose... my dog didn't venture into the neighbor's yard to get attacked, my dog on my side, their dog on the opposite. This a shared fence that I own.

Most likely it is reasonable to expect a dog owner to secure his property such that his dog cannot easily attack or injure anyone outside of his property.

Add it all up and ask your neighbor to pay it. If they refuse, file your case in small claims. Sounds like you have a case for all of the damages you describe.

I think you will have a difficult time prevailing in this matter. Your dog was on their property. Therefore, your dog wasn't secured. If you don't think that is what they will present, you are mistaken.

I'd call a lwayer on that one... I think you have a good case on your hands but I'm no legal expert. You can call any Lawyer up and they can give you free advice.... Hope the pups okay!
