Question about something involving Ebay?

So I recently sold a game of mine, and shipped it out. I guess however a crack go into the case, due to the shipping, which the buyer did not buy insurance for.

They want a refund. Do I HAVE to give this to them, if they did not buy the insurance?

They also claimed it was 'mis represented' I guess it had a small scratch on the third disk. I looked it over before hand, it was pretty much perfectly fine, I think they are just nit picking about small things.

if you packed the game correctly like maybe in a box with bubble wrap or an evnvelope with newspaper or something.
NO you do not have to refund them.

if you did your part and made sure you packed it sufficiently then the buyer needs to make a claim through the shipping company because you did offer insurance.

he can file a complain with paypal and ebay and they will investigate and whatever but if you did your part you have nothing to worry about especially if he didnt buy insurance.

but if you just packed it to where it could possibly get damaged then you are at fault.

i sell stuff all the time on ebay and get those cheapo's who dont want insurance but i pack my stuff well. so when they file a claim they get nothing.

No. I would empty my paypal account NOW. Tell paypal to stick it they ask you to refund.

A liar did the same thing to me with a cell phone. I emptied my account, paypal refunded the liar's money and ask me to pay it. I told them to stick it in their a**. I'm still on Ebay and I still have a paypal account.

NO!! You do have to give them a refund! It's their fault if they did not buy insurance. But if you don't want them to give you negative feedback, point out to them that just buying a new clear plastic case for 50 cents will be a hell of a lot cheaper than sending it back for refund because they will have to pay the P+H. Good luck!

tell him its not your fault he didnt get insurance and if he continues to be a "jerk" about it tell him to stick it up his *** and shut the hell up

No, do as the previous poster has suggested and clear out yourPay-Pal account. crap like this is why ebay is going down the tubes. next time use a local board like Craigslist....Good Luck.

unless they purchased insurance, you do not have to do anything.

thats no your problem... they didnt buy insurance so thats their problem

Much would depend on how you listed the item as they could file a dispute with Paypal and there is the possibility that Paypal might decide in their favor.

In general you probably would not HAVE to refund them anything; however, if you want to keep a good reputation on E-Bay, especially since you admit that you did not pack the items well, a fair solution would be for to ask them to return the items to you at their expense and after you receive the returned merchanise you would refund the purchase price only, not original shipping charges, after all it did cost you to ship it to them.

This way it gives them an option (I did this one time even though I stated "as is" and "no refunds" and I received positive feedback from the customer and actually sold the item return at a higher price when I re-listed it) and will appear more favorable to Paypal that you did try to resolve the matter amiciably and fairly and could be the tipping point if the buyer rejects your offer.
