Cant get a lazy constable to serve this guy so when can go to court!? |
I was rear ended by someone and the guy had no insurance so i had to sue him to get my money for the damage. I submitted the paper work and I have been waiting for months for this constable to serve this guy. I've called and called and he says hes gonna do it but since the guy hes serving works so early he does not want to get up and serve him. I tried to talk to his boss but I cant seem to catch him in his office when I call. What should I do at this point? please please help anyone. (Texas is the location the accident happened). I meant so I can take him to court? sorry It will cost you, but approach the court the case was filed in, and pay for the services of a local server. It does not necessarily have to be served by a constable. In other words, 'fire' him. It can be done. Also (and I live in Texas), according to the Texas Rules of Civil Procedure (I imagine this is a civil case being done pro-se?) you should be able to use a courier delivery service, certified mail, fax transmittal, electronic transmittal, etc. Again, check with the court as they will be able to tell you exactly how they can be served - sometimes a lot easier than you think, especially when entries on the docket are being done by submittals.
