I need legal advice!!!? |
I had a car accident on March 6,2004. A drunk driver hit me in a head on collission. I was hospitalized for about a month. I have had several surgeries on my leg and foot, and I have went through several years of therapy. I still cannot walk normally. I sued his insurance company after the accident and received around $20,000.00. In November of 2006 the driver was sentenced to 5 years in prison, and ordered to pay me restitution in the amount of $200,000+ for my medical bills. I am getting sued for these past due balances. I cannot make payment on them because I am disabled from the accident. My doctor says that my condition will worsen with time. What can I do to get these creditors off my back?? This was not my fault and I don't have hundreds of thousands of dollars to pay! My restitution payments should start when he is released from prison but that is in three years! Can I sue him in civil court for pain and suffering? What should I do? If I decide to sue him, do I need to wait until he is out of prison, or go ahead and start the process? Call the creditors listed on any papers/collections you receive and then send the court judgment (sentence entry) to each creditor. If you do not have that entry you can call the court and request a copy. Just explain who you are. sHate to say this but you should have seen a personal injury attorney before you accepted the insurance settlement. Of course you didn't know that. The first thing you want to do is consult an attorney now and see if you still have legal recourse. Most state you only have three years to bring a civil suite. But there may be something said about you are not an attorney and had no way of knowing this. Please contact a good personal injury attorney, most will work on a contingency basis if they think there is a case. |
