If my driver's side mirror is knocked off by a carriage at a grocery store who should pay for it? |
There was a micro burst at a local grocery store today and my mirror was knocked off by a flying grocery cart. i believe it was the store director's negligence for not clearing the lot of carriages before a major store was going to hit. Why should I pay to have it fixed when it was their store's carriage that hit it. i didn't leave it there. I spoke with the director and he seemed to shrug it off. I don't know what legal action to take. It's costly to fix and my insurance only covers the glass of the mirror, not the actual mirror. ok, there are no signs in the entire parking lot stating they are not responsible for carriages in the lot. This is the 5th time this has happened and i am tired of paying for it. I work at the store and I know the director did not clear the lot before the storm hit. If the carriages were taken inside the store by the front end personnel this would have never happened. I parked as far away from the store as possible. hey all just stood and watched carriages flying all over the lot, but I stormed outside when i saw that happening and tried to stop them. Sorry no case. I park far enough away to avoid this problem. Now if the grocery stores cart person had several carts and then one got away and hit your car, you could have a case. Acts of God are not covered. I would go to a junk yard and buy a side mirror. You would pay a lot less. You would have to bring suit against the store. It will be expensive and may not be successful. Its your responsibility. You park in the lot at your own risk. Most stores even have signs saying that they are not responsible for any damage to your car. You. That really sucks, but if you think about it, if grocery stores paid for all the damages to cars caused by their grocery carts, there would not be one grocery store left in business. Sorry your SOL, Everyone would be filing claims at the Grocery Store if it was possible, I have a few dings myself... i think you are right...the store director was negligent and should have put the carriages in the proper area.if he knew a large storm was going to hit,he should have cleared the lot instead of sleeping in his office.and indeed,it was the store's carriage which hit you.if it was something like a tree fragment no one can help that,but it's the store's and owner's responsability to clear the lot of any of it's objects and merchandise.it amazes me how lazy people can be,and how the innocent have to pay for the negligence and utter laziness of other people.i think that saying it's not their fault and you can't hold them responsable is a stupid way to avoid blame.they should take responsability for their own faults and not act like a bunch of 2-year olds |
