Does someone throwing up on my car count as vandalism? What should I do?


I live in an apartment with my husband and 3 year old son. Two months ago, we had some college-aged boys move in across the hall. They used to throw parties every single weekend until we told them ENOUGH and reported them to the front office. They have been good for the past couple of weeks until last night...

I left our apartment at 3am because our puppy was sick, and I had to take him to an all-night vet. My car was parked outside of our garage which is directly under those boys' balcony. My car was COVERED in vomit. There was vomit next to my car, on top of my car and all over the windshield. AND there were cigarette butts on top of my car too.

I took a bunch of pictures and left it alone. I ended up taking my husband's car instead so that I could show the apartment complex today. But does this count as vandalism? I'm not sure what it's going to take to clean my car or if there's vomit in the vents or anything... should I report to my insurance company? Help!

DELIBERATELY throwing up on someones car can be criminal damage... not vandalism.

criminal damage DOES NOT have to be permanant damage... i work in close protection security, and for a fact, throwing an egg at someones car is criminal damage..... it just depends if we feel the situation is worth an arrest.... it usually isnt

but the crime is the same.

if you have pictures its a start.... but i would have reported this incident to the police before cleening it

Vomiting on your car and throwing cigarette butts on it seems to me like intentional and definitely it's criminal. You should have reported it to the police right away. All to often people do not report the bad behavior of others for fear of retribution. That is exactly what you have here. Smart idea taking pictures. Take them to the police station, talk to the chief of police and tell him you know for a fact who did the act and you expect more deeds like this for reporting their misconduct to the police. Tell him you expect him to do something to protect you and your family from the malicious antics of these wild boys before it gets out of hand and someone gets hurt.

Call the non emergency number for the police and talk to someone there to see if it would count as vandalism. If it does, file a report and then report to the insurance in case you have problems in the future (like paint peeling)and have to have covered repairs. I would also approach them about paying to have it cleaned. If they will not pay up and you want go through with it you take them to small claims court. Maybe it would teach them to be a little more responsible.

These guys are SICK! literally!!! I wonder what they did to make all that vomit! Yes, report it to your insurance company and the Police! That is revolting! Enough to make ANYONE sick! You might have to take a hose to get the stuff off, then take it to a car wash AFTER the insurance company has seen it! Go see the manager and complain again in writing, only THIS time, as HE is only the manager, send a copy of the complaint to the Owner, and, if there are anymore incidents like this one, you will hold him responsible for any further damages done to your property, in the futre, even if they have posted a sign saying THEY are NOT responsible for any damages! I can see a legitimate accident happening, but this kind of vandalism was PLANNED, to get even!

I'm not really qualified to answer this question, but I just had to comment! Oh my gosh! That is just plain disgusting! I lived in an apartment for 2 years and have vowed to never live in one again. I can't tell you how many times I would go out to my car in the mornings and find stuff on my car. Soda splashed on the windshield, car doors, etc. I even had a small crack put into my windshield once, but couldn't have anything done about it because, according to neighbors, no one supposedly did it. I lived in a older building so the walls were incredibly thin and I went through countless nights of udder hell with one neighbor in particular, him having parties and just being loud in general. I would think, since you have pictures of all of this, that it could most definately be considered vandalism, but at the same time, if no one saw who did it then it would be difficult receiving any justice in the matter. I know that first hand from having similar dealings with matters like this. But, good luck and I hope these other tenants receive some kind of punishment for this, your landlord needs to step up and do something.
