You dont really 'need' a lawyer for anything, a citizen can file any type of claim in court that he wishes.

Be advised the insurance company retains many expereinced attorneys, you as a layman, will be at a distinct disadvantage.

No you don't need to, but it is a smart idea because the insurance company is probably going to jerk you around until the statute of limitations passes and you can no longer sue them.

If you have car insurance, they will typically go after the other insurance company for you to make a claim against the persons policy. :-)
