Involved in an accident, Insurance doesnt cover med bills, what can we do?


Me and my boyfriend were involved in a near fatal car accident. It was 100% the other persons fault and his auto Insurance has already taken blame. I got a rental car and a check for my totaled car. Now the problem is that the guy that hit us did not have enough insurance on his car and now we won't be getting our medical bills paid for, money for the accident, or continued treatment for our injuries. Our lawyer advised us of this and says her hands are tied because the Insurance just wasn't enough. Our hospital bills alone top over $10k each, plus doctor visits after, my boyfriend has a fractured back that could be a life long injury, he has been out of work and not receiving lost wages. I cannot afford to support us both and we need treatment. The guy has no assets to liquidate because we were thinking of suing him personally. Any idea or help on what we can do? We are in a very bad situation and it seems as though there is nothing we can do...please help.

Talk to a personal injury atty who specializes; but if the guy has nothing, you can't get blood from a stone; all you can do is get judgements and wait and hope for the best

You didn't have UI coverage on your insurance? This is exactly the situation where you need it.

All you can do is sue and get a judgment, but like you say, if the other party has no assets (typical), you're unlikely to collect.

Fire your lawyer, who is giving you bad advice, and hire one of those law firms that advertise on TV. You can sue the other driver's insurance company. This is about the only way for you to get the money you're going to need.

I would sue him anyways and have the guys wages garnished until he pays in full.

If the guys insurance is maxed out and he has no assets...you are right. there is nothing you can do. You can't get blood from a stone.
Thats why you need to have proper coverage, because there are people out there with little to no coverage.If a person has no assets, they have little incentive to carry high levels of insurance. They have nothing to protect and if you sue them, you can't get anything (like a house, boat, car, bank accounts etc)

All you can do now is sue him, get a judgement and garnish whatever wages he may have, if any. If he comes into money or suddenly "finds" property, you can take it. Unfortunately, you will need to hire a lawyer. Lawyers want $$$ upfront if there is no money to be gained. No lawyer is going to rep you on contingency if there is no money to get down the road. If they win, they also get no money, since the guy has none. They are in businees to make money.

Bottom line, you are screwed. Unless your policy will pay you, you can't do much except file for Social Security disability if you are unable to work and are totally disabled.

and of course, get better car insurance so you are protected if this happens again. Thats the point of car insurance. To protect YOU.

That is a horrible situation, and I hope you get through this. My honest opinion is to hire a Personal Injury lawyer- I am not sure if that is the type of attorney you have now, but you need to hire one of these guys. Most of them will not charge you unless you win your case. Even if the other driver does not have enough insurance, or assets, that is just him. When you sue someone- you can go after anything and anyone they are tied to- including family. Sure its a tough path to go down, but it is a harsh reality and the person responsible needs to be responsible and pay for what they caused. Sure you have your lives, but your standard of life has decreased so much and you are in so much debt- hire a Personal Injury lawyer and they will work hard to get you both what you need. He or she will know how to use the laws to your advantage.

Other than sue him personally, there is not another place I can think of to recoup any of your losses. That is why states needs to raise the legal limits of insurance people carry on the vehicles. I carry a million dollars worth of coverage and what the insurance companies do not want you to know is that you carry that much for little increase on your premiums.
With the economy growing like it is, we need to carry more coverage on our vehicles to protect us as well as someone we may cause injury too in a wreck. Good luck..........

If you have car insurance, check if you carried "uninsured or underinsured" on your policy. If you did, file a claim with your own insurance for coverage. You might also check with your health insurance carriers, as sometimes they must pay if the auto insurance is totally paid out. If none of this works, get all of the treatment you can and then file bankruptcy to get rid of the debt and start over. If you do this, wait as long as possible to file and get all of the medical treatment you can before filing, as you can only file Chapter 7 once every so many years.
