Need Advices..?


Long story short, I'm suing this guy and taking him to a small court involving in an auto accident. I have liability and his car is not insured. He reversed his car and it hit mine - so to prepare for court, I need to gather any kind of informations (envidents) that will help me prove my case. I have a police report (not filed on the scene, but I filed it 5 days later), pictures and different estimate of how much it will cost to repair the damages on my car. I want to know if I should get any informations (documents) from my auto insurance company stating that they check with DMV and their records shows that the guy didn't have insurance on his car and that the car belongs to him. Any suggestions will be great! Thanks.

I'm not going to tell you all the things you should have done. The important thing is yes, you should contact your insurance company and get all the documentation (estimates they have, etc.) pertaining to your cost, including (but not limited to) their research on the other guy's insurance status, etc.

You should carry a disposable camera in your glove box, and take pictures of the accident from all angles before moving the vehicles, for proof that he did back into you, and that you did not run into him, you should have called the police immediately, to file a report, not five days later. You may have a really hard time proving it, unless the damage to your car shows indisputable proof that you could not have possibly hit his vehichle, ex: the angle of collision. Good Luck...
