Sued For Car Accident in Ontario Canada?


I got served with papers the other day regarding an accident I had with a man back in December. It was my fault. He didn't have any serious injuries, he went to the hospital and was released right away. He is claiming he can't work due to back pain from the accident and that he can't "Do handyman chores around the house and has to pay someone else"
I have full coverage with my insurance, have never been in an accident or had a ticket of ANY kind in my 11 years of driving. He's wanting $200,000. If I lose the case, what will happen with my insurance? Will it be raised? I was charged with "Turn Not In Saftey" 2 demerit points. What do you figure will happen?

Forgot to mention-my insurance company is hiring the lawyer and taking care of everything. Will I have to repay the fees if I lose?

Exactly, just send the S&C that you were served to your insurance company, and they will take care of it. You won't have to pay their attorney's back, this is what insurance is for. They may raise your premium, but just like the representative told you, they won't know how much until after the settlement or trial is complete. You may be called in for a deposition, but that will be further down the line.

Don't worry. A one day stay at a hospital for a car accident that happened 6 months ago? And complaints of back pain. How common. I am sure this guy had pre-existing injuries that caused the back pain, doesn't have any sort of limited or permanent disability due to the back pain, and I am sure he isn't being treated for it (chiro, physical therapy, etc.)

Believe me, these lawsuits get filed all the time, and the guy has nothing, and if he does have something, your insurance company will settle with him for less then your policy is anyway.

You will not have to pay, however they may raise your premiums or cancel your policy. But they are on the hook for the costs of this accident.

Your premium could easily double or more. if you had safe driving discounts, you will lose those, and that alone can double your premiums. It all depends on the insurance company.

You will not have to pay any of the attorney fees, your insurance company will take care of it, however you will see a definite increase in your premiums.

You insurance company will most likely settle with the other party.

No, you won't have to repay, but your premiums might go up, if they haven't already.

Edit: I don't know. Ask your agent. They'll probably wait to see if the suit has merit, and if he collects.
