Can i file for workmans comp,if i left my employer? |
Ok, my brother in law fell while delivering couches for a company. He told them he fell, and signed a paper saying so. Another worker seen him fall. He may have gone to the er later that day but never told his employer. He went to work the next day and for three more weeks after and then left or got fired from his job. After he left his job, he says he injured his back. The er did miss it and two months later another doctor found the injury. Since his employer didnt know he had a back injury, can he sue for workmans comp if he no longer works there? He says they never told him he could go to the doctors, and he didnt have his own insurance,but it is a large company and I say the rights and responsabilites was probaly posted and they are going to say he should have known to go for futher treatment with there doctors. In short, he could have asked. he is going to say he quit because he could no longer work, they will say 3 days no call no show, He never said he was hurt. Can he win? The only problem I see in this scenario is the ex employer can claim your brother in law injured himself at another time or off the job and is now trying to use the ex job as the reason. It would be hard to prove since he did not go to a doctor the day of the injury and did not get approval from work to go to the ER whenever he did. so basically it is his word against theirs but most personal injury attorneys give free consult you might try to get a professional opinion of the case. |
