Problem with neighbor?


So, my neighbor has this HUGE dead tree that is right next to our driveway, but still on his yard. He refuses to cut it down, or to chop off the branches, or to have anything done about it. Dead branches keep falling off of the tree and hitting our cars, they've been small so far, not leaving much damage, but I'm worried about the big ones. Is there anything that I can do about this? We've talked to lawyers and everything, but I'm not sure if he has insurance (in fact, I highly doubt that he does), and we really don't want to have to spend the money to take him to court. Other than not parking our cars in the driveway (which we've been doing for the past 2 weeks), do you have any other suggestions?

Here's a few.... city zoning office to have him comply with removing a nuisance... if not in the city, call the county, same thing... Send him a notarized certified letter demanding he identify his homeowner's insurance company. (He may not do it, but at least you have the fact you asked when the tree comes down.)

Put your homeowner's and car insurance company on his ***. They will hound him to death on your behalf rather than pay out a big damage claim.. :)

And you do have the right to have a tree removal company come in and cut the branches off that are protruding over your property, do that and then sue him in small claims court for the cost.

call your council or local authority and report the tree, insist they send someone round to inspect it as you are concerned about the branches etc. they should be able help you, or at least point you in the right direction as to what to do next

If the tree is hanging over the property line just cut off all the branches that are hanging over your property.

I wonder if small claims court would be an option? It seems like people sue others for the smallest of infractions so why not?
