Accient with police officer? |
In the summer of 2006, i was in an accident with a police officer. We were driving down route 70 (a major highway 50 mph) and a police officer decided to blow a red light with not siren or lights, hiting us, making him flip and making us spin 180' and stop instantly, nearly killing me and my dad (i woke up to the sight of my dead father slumped over the wheel, but for god knows why he started breathing again.) The officer walked away fine without ever talking to us in the hospital. My dads head went through the side window, and he lost all feeling in his right knee (he was already overweight and like 50 but no stroke). I dont remember anything. I had a closed head injury (got CAT, neuropsychological evaluation, EKG...all proved a closed head injury or brain damage). I have memory loss and my grades slipped dramatically. I fell into depression and im seeing a psychologist now. In the end, we spent (if we had no insurance) + $100,000.00. Thanks to the Tort Claims act, we cant get sue... The Tort Claims Act protects the police office. We can't sue for a dime even though all, and i mean ALL, evidence and witnesses and video show that it as the police officer's fault... What jurisdiction? What state at least. If you can't sue the city directly, sue the police officer who will seek contribution from his employer. You have been given some seriously wrong information. you definitley need to hire a lawyer and go to court |
