Legality of employer canceling Health Insurance? |
My husband was fired from his job on April the 2nd. I called the insurance company today to find out when the health insurance ran out. I was under the assumption that you always had 30 days after termination on your insurance. Well my husband's employer canceled it on the 1st which was actually the day before he fired my husband. My question is, is this legal? Aren't we entitled to 30 days with the insurance? Thanks for the answers everyone! My husband was fired for some very inane reasons. This was a small family owned company, and it was the owner/boss that made the cancellation date not the insurance company according to the insurance. Apparently we can't get COBRA, it would be to expensive anyway I'm sure. depending on the size of the company (many businesses are not covered by COBRA or, for that matter, any labor regulations) and.............. If he was fired for gross misconduct then he has no right to insurance. Yes that is legal. Your husband should have the option of paying "cobra" for his health insurance for so many months or until he finds "new insurance", or a new job with insurance. Why should the employer pay for health insurance if that person is no longer employed. Health insurance is very, very expensive, even for companies. Nothing in life is free. The length of time you are entitled to insurance is dependent upon the contract with the employer. You do have the right to purcahse health insurance at the same rate that the employer paid thorugh a federal program called COPRA, but the former employer is not required to pay for health insurance for a terminated employee. It probably wasn't the employer that selected that date, but the insurance company based on their plan document. You're entitled to remain with the same plan you had while your husband was employed for 180 days - the catch is that you now have to pay for all of it out of your own pocket. You have to check the insurance policy... The employer was in his rights to cancel the insurance if he was paying for it.
