Not necessarily. If you were driving and you are a EXCLUDED driver, then NO the other person's insurance does NOT have to pay. You can NOT compel any company to pay for anything that involves a 'commission of a crime', which is what you would be guilty of. Driving while excluded as a driver is illegal (because you MUST have insurance by LAW and you do NOT) and considered a 'traffic' crime.
If you had not been a EXCLUDED driver, then yes, the other person's insurance would have to pay.

If the police rule that the other car was completely in the wrong (rare, usually shared responsibility) then theirs will cover it. Usually the insurance companies get together and negotiate who's going to cover what portion of the damages.

However, if you are specifically excluded from the policy on the car you were driving, you were essentially driving without insurance. In which case, you will likely not get full insurance payout on the damages.

Depends on what the police report says. Turn the claim into the insurance company and see what happens.
