Can i take an insurance company to court over a year later? |
i got in an accident, and they will not cover my hospital bills. the polics report clearly states that is was not my fault. this is my insurance company, and they already paid me for my car. Yes you can You can still take them to court, but was it your own insurance company or the other drivers insurance company? The statute of limitations in most states is two years, but find a lawyer and discuss it with him/her. If you're still within the statute and it's a good enough case (a bad case would be you're suing for $100 in hospital bills, you know what I mean?), you should be fine. Yes you can, but it seems odd to do so after waiting so long especially if you weren't in talks with them for a settlement during this period. Before taking them to court you need to come to them with your problem and tell them why they are required to act on it. Find out what the statute of limitations in your area are. That would be my advisement for the first stop. Good luck. Also read the fine print in your policy. Whose insurance company is this? If it is the other driver's you need to take him or her to court, not the insurance company. I think in small claims court, you get up to 5 years, after that, its a no go! So good luck, you should have no problems. |
