Can i take an insurance company to court over a year later?


i got in an accident, and they will not cover my hospital bills. the polics report clearly states that is was not my fault.

the incident happened in 1/07

is it to late for a lawyer to take them to court?

this is my insurance company, and they already paid me for my car.

they just wont pay my medical bills, and they are hefty because you need to "by law" get so much done if you are in a vehicle accident

At the time of the accident did you file a property damage claim with the insurance company, either yours or theirs? Property damage claims have to be submitted to the insurance company within 30 days of the date of loss (date of accident).

If it is your insurance company and you don't have property insurance coverage, you will not be reimbursed for the property damage to your vehicle.

The statute of limitations in most states is two years, but find a lawyer and discuss it with him/her. If you're still within the statute and it's a good enough case (a bad case would be you're suing for $100 in hospital bills, you know what I mean?), you should be fine.

Yes you can, but it seems odd to do so after waiting so long especially if you weren't in talks with them for a settlement during this period. Before taking them to court you need to come to them with your problem and tell them why they are required to act on it.

Find out what the statute of limitations in your area are. That would be my advisement for the first stop. Good luck. Also read the fine print in your policy.

Whose insurance company is this? If it is the other driver's you need to take him or her to court, not the insurance company.

I think in small claims court, you get up to 5 years, after that, its a no go! So good luck, you should have no problems.
