Can i sue or file a law suit against one of my classmate who hit me with this car?


last year, one of my classmates hit me with his car (even though it was a slow impact) just for fun. But even now i have lots of knee pain and i went to 3 doctors and spend thousands of dollars (after insurance coverage). That guy never even called me on phone to ask how i am. I have lots of pain and need money for the treatment. Is there any way that i can file a law suit againt that guy?

However since he was my classmate and i didnt feel the pain at the time of accident, i did not file an complaint. can i do it now?

However when this incident happend, one of my friends was videotaping me . The video did not caught the impact of the car, but the moments after that where i laughingly caught my classmate and told i will sue him (I was laughing beacuse he hit me for fun and i did not feel any pain at that time).

Please give me some suggestions.

If you are not 18, then you cannot sue anybody. Your parents would have to file the suit.

However, before you consider filing suit for what appears to me a bogus claim, your parents should file a claim through the driver's insurance company. They will review the details of the accident and determine if their insured is legally liable for your injuries.

It sounds as if you have a good deal of comparative negligence, and depending on what state this occurred, you may be barred from any recovery.

Assuming they accept the claim, you will need to prove that your knee injury is causally related to the accident. You will need medical documentation. You claim that you went to three doctors and spent thousands of dollars. What exactly is your injury? Your injury may be considered questionable at best.

If your injury is causally related to this incident, it does not mean that you are entitled to monetary compensation. The tort threshold requirements vary from state to state.

See a PI lawyer immediately. You generally have two years to sue and half the time has run. Be honest and tell him about the video.

Hopefully, your doc's records will reflect that your injury was from this collision.

Get your insurance company to send you their records of payment for these injuries.

Hopefully, the guy who hit you has insurance.

Its really unlikely that even if you sued him you would get anything. There would be no way after a year to absolutely prove that your knee pain has come from that specific incident and not from something that happened during the rest of the year. A judge would likely throw the case out as it really seems like a bunch of kids playing around.

There is a time frame that you can file, varies by state. But you really don't want to go through the hassle, it's not worth it.

See a personal injury lawyer. You've weakened your case by your initial lighthearted treatment of it, but not seriously.

Chalk it up to immaturity and move on with life.
