How long does a person have to file a police report when they have an accident? |
I have a friend that was driving on Lake Shore Drive and he rearended another vehicle. There was no damage to the other car, so he failed to call his insurance company or make a police report. He was depressed and now he wants to get his car repaired. At first he was going to pay for it out of pocket, but when he got the estimate it was $3000.00. So, six months later he has no police report and he hasn't made a claim. What recourse does he have? Can he make a late report and file a claim? He is insured by State Farm and has been with them 35 years. He is retired. It should be done as soon as possible. The Police won't do a report that's six months old. If he's covered, the insurance will pay, minus the deductible. You have a reasonable amount of time to file a claim. Since your friend waited 6 months, nothing is going to happen. If anyone needed to file a report, it should have been the driver he hit. The insurance company is going to wonder why there is $3,000 damage to 1 vehicle & nothing to the other. Did he hit a tank? In most places you only have 3 days. You should file it IMMEDIATELY, for your own protection. Your insurance company may have guidelines that require you to file sooner than your state does, so beware of that as well. If it has been 6 months, his insurance does NOT have to pay it.
