What are my rights if I am scared of the doctor who will be performing a surgery on me?


He did a major surgery on me a few years ago and it failed, caused me much pain and he did it all over again. Then he made another mistake and now he's going to fix it this summer...I am scared of him because he might make more mistakes. I'm not even sure he's qualified, he said I'm his biggest case.

I tried to ask my insurance for a doctor who is qualified but he's out of state and they said they can't do out of state....this is Medicaid.

You have the right to refuse treatment from this doctor. There has to be another physician that is qualified to perform the surgery you need.

You also have the right to be discussing this case with an attorney regarding medical malpractice. Just because you are on medicaid does not mean that you are entitled to receive sub-standard care. You should be checking with your state medical board to find out how many complaints they have received from other patients regarding this physician.

The previous answer was rude as it did not address your question, only the prejudice of the person answering.

I would, in no way, give consent for surgery to a doctor who had previously butchered me. I would be searching for a more competent physician and demanding that proper care be provided to me.

just dont let him do it...you could also just find a different doctor and self pay...instead of making my husband pay with his money that he earns to support his family..that the gov. steals from him to pay for you to get surgury and then ask questions like this on yahoo answers.

it's your body. get a 2nd opinion. then, get your own insurance -this will offer you more options for treatment and coverage.

You have the right to get off goverment benefits and find a real job with insurance.
