Seat belt violation?


i live in the state of ct and was given a citation for not wearing a seat belt. i checked with my insurance co and was advised my rates would go up once i plead guilty and pay the citatin. should i fight the ticket? how can he prove my seatbelt wasnt on? its my word against his? its my first seatbelt violation and i have no other pts on my drivers license? is there any chance on beating this ticket? its only $38 but i do not want any pts on my drivers licesnse? will it still show on my drivers license even if the court throws the ticket out

If it's your word against his - you lose... simple as that. And no I don't think it's right but with traffic tickets it's: guilty until proven innocent.

Best chance go to court and if the cop doesn't show, plead innocent and the case should be tossed out. BTW, if your insurance goes up for 1 seatbelt ticket, get another company - that's ridicules.

They likely have you on videotape from the patrol car.

Pay your fine and take your lumps. Then buckle up from now on.

best chance would be to talk to the court clerk see if there is an option.. in some areas they will throw tickets out once a year if you attend defensive driving.. if not then you are in all probability going to have to pay the fine and put up with a rate hike..

one thing i would HIGHLY recommend is that you NOT fight it unless you are innocent... you do NOT want to commit perjury over a couple of hundred dollars...

his word against yours is a nice thought but remember if you are lying in court you are committing a felony to get out of a misdemeanor...

if the money means that much to you get a lawyer.. find out how much to fight it.. he can at least do it without you lying in court.. ( usually they show up and ask for a continuance.. unless the officer isn't there in which case thye ask for a dismissal... they keep doing this till he doesn't show...)
