What is a truck driver entitled to if he gets into an accident that isn't his fault?


I would like to know what a semi driver is entitled to by his company if he has an accident that wasn't his fault. Specifically, if someone hit him and that person was killed, but the truck driver is not injured. Besides the damages for his truck, what should his insurance or employer provide? Should he not be given a significant amount of time off and be paid while he is recovering from the trauma? I think that it would be very hard for a trucker that has gone through this to get back to work without some kind of therapy, having seen someone die. Does this have any validity? If so, do you know of any companies or lawyers that would help the truck driver get compensated? Any 'truckers rights' type of thing?

The accident would be treated like any other accident. The driver that lives isn't given counseling and time off by the insurance company. The business may offer some kind of therapy but they are not required to do it. The driver's health insurance may also provide some benefits.

Just curious but what do you mean by "significant amount of time off"?

they will scour the drivers log books,speed,any skid marks and look to put the driver in prison for manslaughter regardless of fault.

I'm a driver. I don't get what you are getting at...if you are injured at work, then you get the normal workman's comp, but emotional damages? Maybe you'd have a case for that if you could prove your employer caused the accident somehow, which is highly unlikely.
I haven't been in a wreck that I was involved in, but I've seen plenty of people get killed in highway accidents, there is an average of 40,000 highway deaths every year in the USA. I doubt I'd personally feel guilty if someone ran into the back of me or something, since it was not my fault. If it were my fault, I have no idea how I'd handle that, it would probably kill me.

Stimpson's brother's story is all too common. The truck driver gets the blame for someone else's mistake. They always try to blame us., and we have to prove our innocence, because we are presumed guilty from the get go.

My stepbrother was a trucker. He was driving late at night when a drunk driver hit him and was killed. The drunk driver did not have the headlights on on his pickup truck. The semi truck's warning system failed to alert my stepbrother that there was a vehicle in dangerous proximity. Nonetheless, my stepbrother lost his job and had to go to court. He lost the ability to own a car for several years as well as being blacklisted from trucking the rest of his life. I carry his car on my insurance and it's in my name just so he can get to work and back and have some kind of life. He was royally screwed by the trucking company. They were never held liable for the fact that their warning system failed to work.
