My husband has a CDL and it was suspended without being notified...? |
Turns out this was back in 2006 for an unpaid traffice ticket according to a SD court house. He works for a concrete company and needs his CDL to work. Now it is my understanding is that the insurance company for this place has to pull an MVR every year...Dont you think this suspension should have showed up sooner? Low and behold, since he was unaware that his licesnse was suspended, he got pulled over and went to jail. he went to court, paid the ticket, and recieved an new license all in the same month, now we got a letter saying it was now revoked? how does this work and what are the procedures of notifying someone that their license has been suspended in SD? I think we should bring this infront of the states attorney, does anyone have any helpful advice for me on what i can do for him? This is your husbands problem, he is the one to solve this problem and act like a man not leave the worry all on you.in there, He probably was notified, but didn't pay attention to his mail. Besides, it's common knowledge that if you don't pay a traffic fine, your license will be suspended, and ignorance is not an excuse, and will not stand up in court. It is not his employer's fault for not notifying him. Many employers say that they will do certain things but do not follow through with them (there's an expense involoved with pulling MVRs). If it was so important for your husband to have his drivers license then he should have paid the ticket he got! They can only notify you according to the address the dmv has so if you've moved, it isn't their fault they didn't have the right address!! All this mess is your husband's fault so there is no reason to go before anyone! He needs to learn to take care of his business so he doesn't have these problems!!! the court will say that the traffic ticket was notification. they don't just go away. All states are in a reciprocity agreement with one another as far as suspensions, points etc. So, if hubby gets a ticket in another state, it is the same penalties as if he gets a ticket in his home state. |
