False info on police report? |
Last month, I was in a car accident. I was stopped at a stop sign and a man not paying attention crossed over the line and drove straight into me. I tried to beep and he heard it but it was too late. The man got out of the car, appologized. Luckily my mother works right next door and her and a man she works with came outside. The driver of the other car told them both it was all his fault and he was sorry. My car is totaled. Well, a few days ago I got a call from my insurance company saying that the accident was 50/50. So, I went to the police department, got a copy of the police report and its completely wrong. It says I was moving when I wasnt, has the man taking a left instead of a right etc. What can I do about this? by the way the officer at the scene was one of the police chiefs wives. We have the same insurance company and he leases his car so they have to pay out his claim so they are gonna want to screw me over on mine. What state are you in? I work for a personal injury attorney. Maybe you should contact one RIGHT NOW. If you have State Farm or he does. YOU ARE SCREWED. State Farm is Satan's Farm. They won't pay you a cent for anything. You could be dying and they will say that you're at fault. Get the police report changed. Get the witnesses to testify to the fact that this other gentleman was at fault. You can definately do that but if you wait much longer, it will look like you're covering something up. Get there right away. Much luck to you in this process. It will be a long road ahead of you before you get payment for anything. Insurance companies love to take your money but not give out money when you're in need of it. i would hire an attorney. nd the 50/50 is crap. i would fight the police records, through an attorney. although it may be hard. i would sue the guy civily, outside his insurance, that is legal and then i would switch insurance companies, because an insurance company has a duty to defend you, and it doesnt look like are defending your position, only going by the police records only. and if you have witnesses, then that elps you all the more. Your insurance company will handle this. Since you have witnesses to his apology (handy hint: never apologize at an accident scene), your company will take their statements. theres always THREE sides to an accident story,your side,his side and the truth.what does the police chiefs wife have to do with a damn thing??And its just a wild guess that you were able to recall everything about the accident in real time perfectly??if so,you are among the 2% of people who can do so,congrats!!! File your OWN police report. Have the witnesses file one as well. Tell both insurance companies you would like this investigated. You would have been required to sign the report at the scene and should have noticed then if the account was not accurate. I doubt there is anything you can do at this point. let your insurance know about this and what you can do.. start by calling the police dept. did you talk to the cop, or did just he file a report? get a good lawyer and bring that guy to court and get some money out of him!!!!!!!!!hahahahahahahahahaha get a lawyer. hi Challenge your claims adjuster to do a proper investigation. He needs to get his own statements from both drivers and any witnesses. He needs to inspect both vehicles and photograph both. He needs to do an accident scene diagram, take photos, look for skid marks. He can, if necessary, hire a reconstruction expert to determine how the accident happened. Take up up with the police officers superior immediately. Last year my daughter was stopped at an intersection in the left turn lane, a car side swiped her on the right side, then crossed the median and left the scene of the accident. She got the tag number, and called police. They stopped the other car 4 miles from the scene. My daughter was by herself, on the way to work, the other car had a girl and her brother, plus a friend. They said my daughter hit them. The police did absolutely nothing, did not cite the driver for leaving the scene, and their insurance company refused to pay because the police didn't charge anyone. Don't let up on the police, no matter whose wife is whose. Also, make it very clear to their insurance company that you are going to sue them and make sure they know that you have witnesses. Don't wait another day to get in the police superiors face. The street officer are many times just plain lazy. Good Luck to you, I hope you come out better than we did. Well, you will have to get an attorney and go to court and contest this. But, I wanted to add that in my state, in Louisiana, there is a state law that it is 50/50 and this is even if the person ran a red light and totaled your car! This happened to my Dad and we could not believe it was true. We found out that not only Louisiana but other states have this same stupid law! It is because the Insurance companies are greedy and only want to pay 50 percent of your totaled car! I would see a lawyer. Bye! |
