Do I have to pay the parents?


My son was throwing rocks with one of the kids in the neighborhood. The boy's sister was hit with a rock. The mother took the little girl to the doctor. She used her insurance but told me to pay them the amount of the bill. Is that possible?

My son is only five. She wants me to pay her the hospital bill. I have already paid the deductable at the checkout. The bill has been paid by the insurance company. There was no balence, she wants me to pay her the amount her bill came up to( what the insurance company paid).

People can sue other people for any reason and they can win judgments.

The question is, can you collect after a judgment has been awarded?

Yes, the mother can use her insurance to pay for the care of her child.

Now, if the bill is X amount and the mother submitted the claim and she only had to pay Y, then you should only have to pay what the mother paid. To pay another amount than X, would set the mother to be profiteering off her child. This would not be right.

Golly gee willikers, what a tangled web.

1. You are liable for the torts of your children.

2. You are therefore liable for, not only the medical bills, but for pain and suffering (I mention this for a reason).

3. You are liable to her MEDICAL insurer for the expenses THEY paid (called subrogation).

4. So, what she is asking for, is that you pay the total amount, even that which was paid by the insurer.

What is peace in the neighborhood worth? You should, of course, have your son work off the bill, but you folks are responsible.

From a legal point of view, you pay the money, but get a release that releases all claims that the mother, individually, the child, individually, and the mother as parent of the child, may have against you.

She must also indemnify you for any other claims that could be made (so if the medical insurer goes after you, SHE has to pay it out of the proceeds you paid her).

You should look up a "Release and Indemnification Agreement" on line, or at the library. Easy form, protects you, protects your son, and make peace in the neighborhood.

Do you want to be sued? No? Then I'd pay up. But make sure they sign something saying this was full and complete payment for the incident.

Your alternative is to ignore her, but on top of causing rancor in the neighborhood, you will run the risk of being sued. Probably a slight risk, if the amount is slight, but the risk is there.

You should be paying the bill, but only the difference of what she had to pay that the insurance didn't.

If you don't pay, they can either sue you or put a claim on your homeowner's insurance...it might be less costly to just pay the bill.
