Son (18) got into fight at school and broke a boys nose.?


The victim was in a "cage fight" the day before, and not checked out by a doctor. My son is being charged with felony assault, the boy will probably need surgery for his nose, which the parents state they have insurance, and want us to pay for the deductible. We are friends with parents, and they are very nice about it. What can happen with my son who's initial court date is tomorrow, Wednesday? My son just got off juvinile probation a couple of weeks age for fighting another teenage boy-not hurting him. Good boy-bad judgement. The police officer commended my son on how respectful he was and honest, but that doesn't help when you're in jail for the first time. Any suggestions? thank you!!!

There is a pattern to your sons behavior if this in not the first time, so it is doubtful that he is a "good boy"

Too bad the officer couldn't commend your son on knowing how to avoid trouble.

Sounds like you have a distorted view of what a "good boy" is.

My suggestion is to hire an attorney immediately for the present cases(criminal and civil it seems like), and keep him or her on retainer, as it seems like your son is going to need it when he gets out of jail.

As for longer term advice, may I suggest consulting with a family therapist, because you are describing a very dysfunctional family.

He's eighteen and an adult. Since he was previously on probation for assaulting another person, I'd send him to behavioral boot camp before he gets any worse. It may not be the answer you wanted to hear, but you need to nip it in the bud now.

You'll probably have to pay for his medical bill and he will either get probation again, or some jail time. Sorry.

Think he should spend time in jail and maybe it will grow him up, and then take a manditory anger management course!

My son is 6 ft 5 and 210 lbs. He came home and told me some big football player kid was trying to pick a fight. My son told me he just turned away, grabbed his (my son's) baseball bat, and ran. I asked him why he ran. He said because if he hadn't, and he was injured, he knew I would have asked him "what's wrong with your legs?"

It sounds like your son's parents have made excuses for his behavior too many times, I see 3 in one paragraph. Since his parents haven't taught him self control, the state will. I'll just bet you are a democrat. Lessons learned too late, are usually learned too hard. You are even trying to help him out of the consequences of his own actions by not insisting he pay for the deductable out of his own funds. My condolences. Try taking him to a military recruiter. The military may be willing to intervene in order to get a new recruit. The court may see the benefits of letting the military solve his anger issue and not burdening the state.

It sounds like your son has a problem with controlling his temper if he has been in trouble with this before already. I find it hard to believe that he is just a good boy using bad judgment. There are issues that he needs help with. His initial court date will be an arraignment. It will not take long. He will then get a plea hearing after the attorney has received the discovery in this case and then he can opt for a jury trial. He will most likely get probation, community service and have to pay a fine. It might also be ordered for him to pay the medical bill for the victim if he is found guilty.
I work for a criminal attorney and I can't tell you how many parents I see that started of saying that their juvenile was a good kid....or was at the wrong place at the wrong time. Some of these "kids" have gone on to either commit other crimes and ended up in jail as an adult. You know your child but don't be blind to the reality that there may be a problem.

The main issue is going to be whether or not he broke the boys nose, and it will be up to a prosecutor to prove that he did in fact break the boys nose. Do you have proof that this boy was hit in the hose at the cage fight? When it comes to a felony case, the prosecutor will pull out all the stops he can, even if it is watching the entire cage fight to see if the boy was hit in the nose during the fight to determine who broke it.

Please understand that during the fight at the school, even if he did or did not break his nose, just being in the fight with him and making him plead he could have been charged with felony assault.

I do have a couple suggestions for you:

1) Get your son in anger management classes ASAP! This will show the judge that he is trying to get help without the court forcing him to get help.

2) Obtain as many letters of recommendations for your son as possible and have your attorney or public defender present these to the judge.

3) Pay the insurance deductible. This will help greatly in the smallest of ways.
