Can my Granparents Sue Me and Win? |
My grandparents purchased a vehicle for me when I received my license. They told me to pay them $2,000 and the rest would be a gift. I paid the $2,000. Today, I received a letter from their attorney stating that if I dont make monthly payments to them for a total amount of $12,000 they will force me to pay that whole amount. The title of the vehicle is in my name and always has been. The car insurance as well has always been in my name. Also, there was no written contract between me and my grandparents. Does anyone know the legalities of this and if they can sue me and win? Please Answer Well.....If they wrote a check to a dealer or financed it, there is a constructive notice that they paid for the vehicle. There is also a title in your name without a written agreement for compensation, so the assumption of a gift is there; there is also a one time payment you made to them that muddies the "gift" idea. They can sue you, but there is no written contract. So therefore, since you never signed anything stating you would pay them the full purchase price (which you didn't). No signed contract usually means it didn't happen, and it is considered a "gift." Their lawyer probably told them the same thing. You REALLY should have made a contract. If they are not listed as a lien holder and there is no written contract, than it will be hard for you grandparents to prove their case. I may try to talk to them though. As everyone has said "they are your grandparents." Talk to grandparents and be nice as you were when you first approach them for the money. Be kind with respect for their kindness. They're your grandparents. PAY THEM. Be hard for them to prove their case I think with no paper trail. by the sounds of it they would win. |
