Vocabulary help. Or legal terms for exaggerated claims/mountain out of molehill?


Is there a term or phrase for this situation?
I didn't fill a form in fully at work as I was awaiting additional information to come, so sent it off with what info I had. It was an insurance form.
A functional manager (not my boss) has made such a big issue over it, saying it was laziness. It wasn't at all - I just thought it best to send form off to register incident, and then when the remaining info came in was going to update).
He has put pressure on my boss to discipline me saying it was incompetence; laziness; and I have ruined the company's image; given the company a bad name; caused unneccessary administration and costs; lengthened the time the process should take.
I have now received a disciplinary form for Gross Misconduct. But the whole thing seems to have been exaggerated out of all proportion. I simply , at a moment in time thought some of the info won't be in for another week, so sent the form off part complete. Is there a term or phrase for what the'yre doing??

I'd say it was harassment.

If you're in a union, talk to your rep.

If not, find out what the appeal procedure is (it should be in your staff handbook) and put in an appeal.

Well that is their opinion and they have a right to do this, they have a right to judge the fact that the form was not filled out. Most states are an "at will state" and this means they do not have to have a reason to fire you, unless of course it falls under the discrimination reasons, (race, sex, age, etc). If you are a member of a union you could go to them on this. If not i do not see any recourse, but to apologize and tell them you are sorry and will improve your performance in the future

Definitely Harassment.

There is absolutely no way an incorrectly filled-out form can be deemed to be "Gross Misconduct", that is reserved for drinking on the job, being drugged up to the eyeballs or physical fighting.

You possibly should have attached a note saying "further information to follow". But it is the job of administration to check the content of a form and followup for missing information.

Go to Personnel and present your side of the case and report the Functional Manager for Harassment. If you have a Union Rep, then take the case up with them.
