How do I collect my deductible from the person who damaged my car?


I was involved in an incident where my car was damaged by another party. There was $3000. in damage to my car. I had to file an insurance claim to get my car repaired right away. I had to pay the $500 deductible, even though it was not my fault. How do I go about collecting the deductible from the person responsible for the damage?

If the other party was ticketed, your insurance company should take care of it for you. That is if the other party was insured. If they were not your insurance company will try, but it may take a very long time.

In the accident did not happen in MI, your insurance company will go to his insurance company and when they receive the money from the at fault insurance company, your insurance company will return your deductible to you. If the accident happened in Mi, you need to talk to your insurance company to find out what you need to do. (In michigan, the most a not at fault driver can collect fromthe at fault driver is $500.00) and you will need to talk to the at fault driver's insurance and prove that your insurance company did not pay for all repairs w/o charging you your deductible.

Depends on your state. I live in a no-fault state (MN) and you can't legally claim the deductible. You can only sue for amounts over and above what is not covered by your insurance (usually medical or property damage unrelated to the vehicle).

Contact your insurance agent and ask what you can do. If the person who damaged your car has the same insurance company, your insurance company is supposed to reimburse you for the deductible.

Talk to your insurance agent -- the insurance company is supposed to collect that from the party at fault. If the other party was found to be at fault, they will pay. No-fault state: you pay your deductible regardless. Your fault: you pay your deductible.

You'll have to sue them in a court of law and then hope they pay. Welcome to the realAmerican capitalist system. Trust me, there's more where that came from.

If it was the other persons fault it shouldnt have gone through your insurance, it should have gone thru theirs. Call your insurance company and see if they can straighten it out.
