Home Insurance?


If someone has home insurance and they have damaged my property can I compel them to request a claim form from there company for purposes of claiming against them or can I request this form from there insurance company directly and are they compelled to send it to me

You do not make claims under other peoples' insurance.

You SUE other people. The insurance defends, settles, and/or pays the claim expressed in the lawsuit.

The relationship between an insurance company and its client is one of contract. This means that only the policy holder can make an application under the policy. You are very vague about the nature of the property damaged and the circumstances in which it was damaged. If it was wilfully damaged, then this may be case of criminal damage, in which case you should go to the police. If it was inadvertent damage, then perhaps the best thing to do would be to bring a claim against the person concerned in the small claims court or county court. They may have an insurance policy covering such claims, in which case it is a matter for them whether they use it for settling the claim as opposed to paying out of their own pocket.

I would not get my own insurance company involved. I would go to the other person, if possible, & ask them to call their insurance company if they wanted to handle it that way & have them call you. I would ask what co. they are with so you will know when they call...the other person said to call your co. but you don't even have to have ins. or maybe you don't but you never want anything written in your records even a claim that isn't your fault. Alot of times your own co. will just pay you for the damages & go into arbitration ( they are then supposed to get the money back from the other person's co) they don't do that & just raise your rates.

You have to make a claim with your insurance company, since it is your property which was damaged. Your home insurance covers your damage or loss, while the other person's home insurance covers any damage or loss to his property. In this case the other person's home insurance has nothing to do with the issue you presented.

You need to make a police report and claim it on your insurance and they will take the proper steps of getting reimbursement from their insurance company!!
