Automobile insurance problems?

I was plowed into by a car going at 40mph while I was wating for someone to turn right. The police report makes it clear this person was at fault+gave them a ticket! Also, I am injured. I am being told that I can't collect insurance from them unless the driver tells them it was his fault! Is this a joke? This was a young kid and I think he might have been impaired also. Does he have to say it was his fault when the police report is so clear?

I think you insurance company is trying to shortchange you. It could be they found that the boy had no insurance. If you state has a insurance commissioner you should check to see if there is a way to have their decision appealed. If not you may need to contact a lawyer. The lawyers costs may be covered by any settlement you receive. You should work this all out before to agree to his service. It is also important that you get some kind of settlement in case you injuries cause problems in the future.

Don't talk to the insurance company any more. Consult a personal injury attorney.
