If you get into an accident and its the other persons fault does their insurance company have to pay the full. |

Go get a quote from another repair shop. It is possible that the insurance company feels that $1500 is excessive. If its the other persons fault 100% and your car is actually worth more then $1500 then yes they have to pay for it Yes the other company has to pay all fees for fixing your car! You should have contacted YOUR insurance to tell them about the accident, they will fight the other company for you, it's what you pay them for!!! If the other party was 100% at fault for the accident, then yes, you should be paid for the entire amount. However, the insurance company will only pay for damage that is related, fair and reasonable. They will not pay for an inflated estimate. Unless the total value of the car is $800 or less than the amount to fix the car, the other person's insurance should pay. I would send your estimate to the other party's insurance company and request the full amount. You are allowed to have your car repaired by whoever you want. If the other party is at fault, their insurance will repair your car or give you what they feel the car is worth, if the car would cost more to repair than total out. You don't have to accept their offer, but they may not make a higher counter offer. You do not have to pay. Sometimes they will ask you to get two quotes and then have you take your car to the cheaper of the two shops. You need to talk to your insurance company. Did they get tickets & you didn't? Are you sure your state isn't no-fault?? You have to sue the other person for the amount you need to fix the car. Their insurance company will have to pay the amount the judge awards you. Unfortunately all the insurance company has to do is pay whats left after the deductable has been deducted. So if you get rear ended, and it costs you 1500 dollars, the person who hit you is responsable for paying you the deductable, they can backrupt themselves around that amount. the insurance company has to pay the rest. That's when people like yourself get a lawyer & sue. |
